What is SPA

SPA is Brazil’s federal betting and prizes regulator — not a single-page web app and not a wellness brand. SPA stands for Secretaria de Prêmios e Apostas (Secretariat of Prizes and Bets), a secretariat inside the Ministério da Fazenda (Ministry of Finance). It authorises, regulates, monitors, and sanctions fixed-odds betting (apostas de quota fixa), online games under that frame, and adjacent prize and lottery activities. Created by Decree nº 11.907/2024 after Law 14.790/2023, SPA issued the 2024 ordinance stack that made the regulated market operational from 1 January 2025. For operators and analysts, SPA is “the Brazilian regulator”: every Brazil go-to-market brief names it.

What is SPA?

In English industry writing you will see Secretariat of Prizes and Bets (sometimes “Prizes and Betting”). In Brazilian ordinance citations the short form is often SPA/MF — Secretaria de Prêmios e Apostas / Ministério da Fazenda.

Portuguese Wikipedia summarises the same institutional picture: SPA sits in the direct administration of the Finance Ministry and is the competent body to implement the fixed-odds regulatory marco. Internally it is organised around authorisation, monitoring/supervision, and sanctioning — three subsecretariats that map to how operators experience the regulator day to day.

One-line definition for briefs: SPA is Brazil’s federal Finance Ministry secretariat that licences and polices regulated fixed-odds betting and related prize activities.

How SPA was created

Brazil did not invent SPA first and legalise bets later. The institutional path ran through statute, then secretariat, then ordinances.

  1. Law 13.756/2018 opened a federal fixed-odds lottery frame (modalidade lotérica de apostas de quota fixa). The Executive was supposed to regulate within a set window; full market rules did not land on that original timetable, and a large offshore-facing grey market grew in the gap.
  2. Law 14.790/2023 (29 December 2023) — often called the lei das bets — built the regulatory marco: commercial exploitation rules, advertising, sanctions, and Ministry of Finance competence over authorisation and supervision of fixed-odds sports and online games.
  3. Decree 11.907/2024 (30 January 2024; published the next day) created SPA inside a Ministry of Finance reorganisation so that competence had a named secretariat.
  4. Through 2024 SPA published the ordinance wave (payments, systems, authorisation, AML, tech/RG, sanctions). Gov.br stated that from 1 January 2025 firms without SPA authorisation face the applicable penalties.

A useful FAQ myth to kill early: SPA and the Ministry set and enforce the rules; they are not a shorthand substitute for the statutes that legalised the product class. Legalisation sits in Laws 13.756 and 14.790; SPA is the administrative machine that made the regulated market runnable.

What does SPA regulate?

Fixed-odds betting and online games

SPA’s core iGaming remit is the lottery modality of apostas de quota fixa: fixed-odds wagers on real sports events and on online games framed under the same legal category. A single federal authorisation covers both sportsbook and online games (slots, table games, crash, and similar products as defined in later technical ordinances such as Portaria 1.207/2024). Operators do not hold separate “casino” and “sports” federal licences for this product set.

Lotteries, promotions, and adjacent remit

Beyond bets, the official mission text and the decree competencies also cover commercial promotions (prize draws tied to advertising), philanthropic draws, federal lottery oversight in the remit assigned to SPA, and certain prepaid savings / popular capitalisation structures. For most international iGaming readers those adjacent buckets matter less than the bets authorisation — but they explain why SPA’s name includes Prêmios (prizes), not only Apostas (bets).

What SPA does not legalise

SPA authorisation is not a general gambling free-for-all.

  • Jogo do Bicho remains a criminal contravention under older Brazilian law. SPA Nota Técnica SEI nº 3826/2024/MF states that authorised fixed-odds operators may not offer online games that use JdB rules or the “jogo do bicho” name — even if the title otherwise looks like a certifiable online game under Portaria 1.207.
  • Broader land-based casino reform and other jogos de azar tracks sit outside “we got a bets authorisation, so everything is open.” Do not treat SPA’s quota-fixa licence as a universal gambling permit.
  • Payments rails are not SPA’s creation: Pix is a Central Bank system that SPA payment rules require operators to work with, not a SPA product.

That triad — authorise, monitor, sanction — is how operators should model the relationship: licensing is the entry ticket; ongoing data, RG, payments, and AML obligations are the operating system; enforcement is real.

As of mid-2026, SPA continues to publish operational updates — for example a centralised self-exclusion platform announced on gov.br in July 2026 — so treat the ordinance stack as living infrastructure, not a closed 2024 binder.

Who can apply. Brazilian legal entities organised as sociedade empresária limitada (Ltda) or sociedade anônima (S.A.), with headquarters and administration in Brazil. A foreign branch, agency, or representative office is not eligible. Law 14.790 also requires Brazilian participation of at least 20% of the share capital.

Portaria 827 also sets capital, net equity, and financial reserve thresholds (commonly cited figures include a R$ 5 million reserve and R$ 30 million minimum capital / equity for the principal authorisation). Confirm the current DOU text before modelling cash.

Process (high level). File through SIGAP (Sistema de Gestão de Apostas), the Serpro-built Betting Management System. Analysis windows are commonly described as up to about 150–180 days, with transitional priority rules for the first 2024 cohort. After a favourable review, SPA notifies the applicant to pay the R$ 30 million fee (typically within 30 days), then publishes the authorisation ordinance. Provisional authorisations exist for applicants who paid and are closing residual certification gaps — treat them as time-boxed, not as a permanent lighter licence.

Ongoing. Authorisation is not “set and forget”. Monitoring, RG, AML, payment rules, .bet.br domain requirements, and sanction risk continue for the life of the grant.

SPA VS other Brazilian institutions

SPA is the bets/prizes regulator. Adjacent bodies share the ecosystem but do not issue the federal fixed-odds authorisation.

For market analysts: do not collapse “Brazil gambling regulation” into one logo. Payments are BCB; betting authorisation is SPA; AML intelligence is COAF-centred; state lottery houses are not a substitute federal SPA licence for nationwide private bets.

Why SPA matters for operators

  1. Single federal gatekeeper. Legal Brazil online fixed-odds and online games under that frame run through SPA authorisation. Without it, from 1 January 2025 the penalty stack applies — and banking/telecom enforcement makes “grey forever” a bad plan.
  2. Ordinance stack = product design constraints. Payments (615), systems/data (722), AML (1.143), tech cert (1.207), RG and ads (1.231) are not side policies. They shape cashier, game catalogue, KYC, and marketing before launch.
  3. Public authorisation and enforcement. Authorised brands are visible; illegal sites face blocking cooperation with Anatel. Brand trust and partnership diligence both track SPA status.
  4. Supplier literacy. PSPs, studios, and certifiers must fit the SPA-certified stack. A global platform that cannot meet Portaria 722/1.207 or Pix/CPF closed-loop payments is not Brazil-ready even if the holding company can write the cheque for the outorga.
  5. Compliance boundaries. JdB-named or JdB-rules products are a red line (NT 3826); Pix is mandatory infrastructure, not optional UX (PIX Knowledge).

Bottom line

SPA — Secretaria de Prêmios e Apostas — is the Finance Ministry secretariat that runs Brazil’s regulated fixed-odds bets regime. Statute (Laws 13.756/2018 and 14.790/2023) created the product frame; Decree 11.907/2024 created the regulator; the 2024 portarias and the 1 January 2025 enforcement cliff made the market operational.
